Privacy Policy

At SUPER BOCK BEBIDAS S.A., part of the SUPER BOCK GROUP (“SUPER BOCK”), responsible for marketing the brands Super Bock, Carlsberg, Somersby and Super Bock Super Rock, we recognize the importance of handling your personal data. We therefore adopt appropriate technical and organizational measures to ensure a high level of security in all data-processing operations.
We want you to be fully informed about our Privacy Policy, your rights, and how we collect and use your personal data.
We commit to processing your personal data with integrity and confidentiality, always for clear and specific purposes.


1. WHO IS RESPONSIBLE FOR PROCESSING PERSONAL DATA?

SUPER BOCK BEBIDAS, S.A., headquartered at Via Norte, 4465-764, Leça do Balio – Matosinhos – Portugal, is the entity responsible for processing personal data, since it determines what data is collected, how it is processed, and for what purposes.
Personal data refers to any information relating to an identified or identifiable individual.


2. WHO ARE THE DATA SUBJECTS?

The customer or potential customer—an individual to whom the data relates and who uses or intends to use the products, services, or campaigns provided by SUPER BOCK.
The representative or point of contact of a company, when acting within the scope of a contract or pre-contractual step between that company and SUPER BOCK.


2.1. What categories of personal data are processed by SUPER BOCK?

i) Contact Information: name, email, phone number, country, address.
ii) Personal Information: date of birth, age, identification number.
iii) Application, website and social media data: profiles, location, behaviour.

For representatives of corporate entities, we only collect data strictly necessary for contract execution, such as name, email, and phone number.


2.2. How, when and for what purposes is your personal data collected?

Your personal data may be collected under the following circumstances and for the following purposes:

1. Through SUPER BOCK brand websites, when you (i) request to be contacted (ii) subscribe to a newsletter.
2. For entering into and performing a contract, including purchase of Party Service.
3. For marketing campaigns, including product information, participation in competitions or events organised by SUPER BOCK, and only when you have given explicit consent.
4. When concluding a contract with us within the scope of our commercial activity, such as distribution or exclusivity agreements.


3. WHAT ARE THE LEGAL GROUNDS AND RETENTION PERIOD FOR PERSONAL DATA PROCESSING?

The legal grounds that allow SUPER BOCK to process your personal data for the purposes listed in section 2.2 of this policy are:

Consent: Your data may be processed based on a voluntary, specific, informed, and explicit statement—such as when you consent to receiving marketing communications, promotions, product updates, or satisfaction surveys.

Pre-contractual steps and/or contract performance: Your data may be required to clarify questions, draft proposals, execute, or manage a contract with SUPER BOCK.

Legal obligation: Your data may be processed to comply with legal requirements, such as tax obligations requiring communication with the Tax Authority.

Legitimate interest: Your data may be required for certain business-related tasks, except where your privacy rights outweigh such interests.
Examples include business management, customer contact via websites or social media, or communication with company representatives concerning contract performance.

Accordingly, SUPER BOCK will process your personal data as follows:

3.1. How long do we keep your personal data? 
SUPER BOCK retains personal data only for the period strictly necessary to fulfil the purpose for which it was collected. In certain cases, the law requires data to be kept for a specific period — for example, information that must be provided to the Tax Authority, which must be retained for 10 years under current legislation.
We will also keep your data for as long as you maintain a contractual relationship with SUPER BOCK. However, we may retain your personal data for periods longer than the duration of the contract, based on your consent, to safeguard rights and obligations arising from the contract, or when a legitimate interest of SUPER BOCK exists, always respecting the period necessary to fulfil the purpose for which the data was collected.
Where no specific legal obligation applies, your data will be processed only for the time required to meet the purposes that justified its collection, and while legitimate grounds exist that allow SUPER BOCK to retain it.

As a general rule, when your personal data is processed for marketing purposes, it will be kept for a maximum period of 5 years from the date your consent was obtained or from your last interaction with us (whichever occurs later), provided you have not withdrawn your consent during this period.

Once the maximum retention period has been reached, your personal data will be irreversibly anonymised (and may then be retained) or securely destroyed.

4. TO WHOM DO WE TRANSFER YOUR PERSONAL DATA?
SUPER BOCK transfers your personal data only when necessary for the purposes described above.

SUPER BOCK’s suppliers and service providers are contractually bound to the same terms and conditions set out in this Privacy Policy. They are strictly prohibited from using, transferring, disclosing, or storing personal data for any purpose other than the one for which they were specifically contracted.

SUPER BOCK may share your personal data, depending on the purpose for which it was collected, with various recipients such as communication agencies, event organisers, transport companies, and other commercial partners. Only the data strictly necessary for these entities to perform their activities within the scope of the purposes identified in this Privacy Policy will be shared.

Identification through social networks: To allow you to log into brand websites and apps without filling in registration forms, SUPER BOCK uses Facebook login. If you choose to log in through this system, you explicitly authorise SUPER BOCK to access and store public data from your Facebook account, as well as any additional information requested during the Facebook login process.
We remind you to review the privacy policies of the social networks you interact with to understand how your data is handled.

Your personal data may also be shared with entities that must receive it by law, such as the Tax Authority.

5. WHAT ARE THE RIGHTS OF DATA SUBJECTS?
SUPER BOCK ensures the application and full respect of all rights granted to data subjects under the General Data Protection Regulation (GDPR) and applicable national legislation.

Right of Access
You have the right to obtain confirmation from SUPER BOCK as to whether your personal data is being processed. If so, you have the right to access your personal data and information about its processing. For example, you may request an exact copy of your data and additional information about how it is used.

Right to Rectification
You have the right to request, without undue delay, that SUPER BOCK correct any inaccurate personal data concerning you. You may also request that incomplete data be completed.

Right to Erasure (“Right to be Forgotten”)
You may request the deletion of your personal data by SUPER BOCK, without undue delay, when: the data is no longer needed for the purpose for which it was collected; you withdraw your consent and no other legal grounds justify its retention; you object to processing and no overriding legitimate interests of SUPER BOCK prevail; other situations provided for by law apply

Right to Data Portability
You have the right to receive the personal data you have provided to SUPER BOCK in a structured, commonly used, machine-readable format, and the right to transmit that data to another controller (where technically feasible).
This right applies when processing is based on consent or a contract and is carried out by automated means. SUPER BOCK may not prevent such transmission.

Right to Withdraw Consent
You may change or withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.

Right to Object
You may object at any time to the processing of your personal data when there are no compelling and legitimate grounds for processing that override your interests, rights, and freedoms, or when processing is required for the establishment, exercise, or defence of legal claims.

Right to Restrict Processing
In certain situations, you may request that SUPER BOCK restrict the processing of your personal data, including when: you contest the accuracy of the data, for a period allowing SUPER BOCK to verify it; the data is no longer needed for processing purposes but is required by you for legal claims; you object to processing, until it is confirmed that SUPER BOCK’s legitimate grounds prevail; in any other circumstances provided for by law

Right Not to Be Subject to Automated Decisions
You have the right not to be subject to decisions based solely on automated processing, including profiling, that produce legal or similarly significant effects on you.

5.1. HOW TO EXERCISE YOUR RIGHTS?
You may exercise your rights free of charge, except where a request is manifestly unfounded or excessive, in which case a reasonable fee may be charged to cover administrative costs.
We will respond to your request within a maximum of 30 days, except in cases of particularly complex requests.

6. PROCEDURAL AND TECHNICAL SECURITY MEASURES
SUPER BOCK uses appropriate physical, technological, organisational and security measures to protect your personal data, safeguarding it against disclosure, loss, misuse, alteration, unauthorised processing or unauthorised access.

7. DATA PROTECTION OFFICER
SUPER BOCK has a Data Protection Officer (DPO) who (i) supervises and advises the data controller on obligations related to privacy and personal data protection, (ii) cooperates with the supervisory authority, and (iii) acts as a point of contact for customers and potential customers to clarify any questions regarding how SUPER BOCK processes personal data.

8. UPDATING THE PRIVACY POLICY
SUPER BOCK reserves the right to update this Privacy Policy at any time. We therefore recommend that you review it periodically on our website to stay informed about how your personal data is processed. In addition to making this policy available on our website, SUPER BOCK will inform you of any changes through its usual communication channels.
